It was concluded that CBD does not behave, in principle as a psychotropic drug and in the current state of scientific knowledge, cannot be qualified as a \u2018narcotic.\u2019 As a result, Articles 34 and 36 of the TFEU that guarantee free movement are, in principle, applicable.<\/p>\n<p>The move was hailed by the food industry as a step forward in favor of \u2018trendy\u2019 products containing CBD. In the rest of the world, the signals seem less positive. <a href=\"https:\/\/food.chemlinked.com\/news\/food-news\/thailand-specifies-the-maximum-amount-of-cbd-and-thc-in-foods?utm_source=edm\">Thailand<\/a>, for example, has set new limits and the <a href=\"https:\/\/tomorrowsfoodandfeed.khlaw.com\/2021\/03\/how-safe-is-cbd\/FDA Warns Companies Illegally Selling Over-the-Counter CBD Products for Pain Relief %7C FDA\">US FDA<\/a> continues to sanction over-the-counter products.[\/vc_column_text]<style>.ld_spacer_6a4cb7753e36c{height:35px;}@media (min-width: 992px) { .ld_spacer_6a4cb7753e36c{height:55px};}<\/style>\n<div class=\"ld-empty-space ld_spacer_6a4cb7753e36c\"><\/div>[vc_column_text css=&#8221;.vc_custom_1679483030180{margin-bottom: 35px !important;}&#8221;]<\/p>\n<h4><b>Le CBD divise toujours quant \u00e0 sa possible dangerosit\u00e9<\/b><\/h4>\n<p>[\/vc_column_text][vc_column_text]\u00ab Il convient de rappeler que la Cour de justice de l\u2019Union europ\u00e9enne a eu en novembre dernier une lecture plut\u00f4t progressiste des deux textes internationaux de r\u00e9f\u00e9rence pour le CBD : la Convention des Nations Unies de 1971 sur les substances psychotropes et la Convention des Nations Unions de 1961 sur les stup\u00e9fiants en concluant que le CBD ne comportant pas de principe psychoactif en l\u2019\u00e9tat actuel des connaissances scientifiques, ne peut \u00eatre qualifi\u00e9 de \u00ab stup\u00e9fiant \u00bb et donc que les articles 34 \u00e0 36 TFUE garantissant le principe de libre circulation lui sont applicables.<\/p>\n<p>Cette d\u00e9cision avait \u00e9t\u00e9 salu\u00e9e par l\u2019industrie alimentaire comme une avanc\u00e9e en faveur des produits \u2013 tr\u00e8s \u00ab tendance \u00bb \u2013 contenant du CBD<\/p>\n<p>Mais dans le reste du monde, les signaux semblent moins positifs, comme cette limite que vient de fixer la <a href=\"https:\/\/food.chemlinked.com\/news\/food-news\/thailand-specifies-the-maximum-amount-of-cbd-and-thc-in-foods?utm_source=edm\">Thailand<\/a> ou la <a href=\"https:\/\/tomorrowsfoodandfeed.khlaw.com\/2021\/03\/how-safe-is-cbd\/FDA Warns Companies Illegally Selling Over-the-Counter CBD Products for Pain Relief %7C FDA\">FDA<\/a> (Agence am\u00e9ricaine des produits alimentaires et m\u00e9dicamenteux) qui continue a sanctionner les produits qui seraient vendus en OTC. \u00bb[\/vc_column_text][\/vc_column][\/vc_row]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>[vc_row][vc_column offset=&#8221;vc_col-md-offset-2 vc_col-md-8&#8243;][vc_column_text]The European Court of Justice had a progressive reading last November of the two international reference texts for CBD: the 1971 United Nations Convention on psychotropic substances and the United Nations Convention of 1961 on narcotics.
